Terms of Service

By using Asphalon ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

1. The Service

Asphalon provides a secure messaging platform with built-in deepfake voice detection, end-to-end encryption, a private browser, and related features. The Service is available via the Asphalon mobile app (iOS) and the web client at web.asphalon.com.

2. Accounts

• You must be at least 13 years old to use the Service.
• You are responsible for maintaining the security of your account credentials.
• One person may create multiple accounts, but accounts must not be used to circumvent bans or restrictions.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited messages, or bulk communications
• Harass, threaten, or abuse other users
• Distribute illegal content, malware, or content that exploits minors
• Attempt to gain unauthorized access to other accounts or our infrastructure
• Circumvent premium tier restrictions or bandwidth limits through technical means
• Use automated bots or scripts to interact with the Service without authorization

4. Premium Subscriptions

• Pricing: Premium is available at $4.99/month (international) or 100 RUB/month (Russia). Prices may change with 30 days' notice.
• Billing: Subscriptions are billed monthly. iOS subscriptions are managed through Apple and subject to Apple's subscription terms.
• Refunds: For iOS purchases, refunds are handled through Apple. For web purchases via Stripe, you may request a refund within 7 days of purchase by contacting aleksandrowicz4932@gmail.com. Payop refunds are subject to Payop's refund policy.
• Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period.

5. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

6. Intellectual Property

The Asphalon name, logo, and associated branding are the property of Asphalon. The underlying messaging protocol (Matrix) is open-source. Your messages and content remain yours.

7. AI and Deepfake Detection

Asphalon's deepfake detection features use on-device AI to analyze voice and behavioral patterns during calls. This system provides probabilistic assessments and is not guaranteed to detect all deepfakes. The Trust Meter score is advisory — you should exercise your own judgment during sensitive conversations.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that deepfake detection will catch every threat. We are not liable for losses resulting from impersonation scams that the AI fails to detect.

9. Limitation of Liability

To the maximum extent permitted by law, Asphalon shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Account Deletion

You may request deletion of your account and all associated data by contacting aleksandrowicz4932@gmail.com. Account deletion is permanent and cannot be undone. We will process deletion requests within 30 days.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the app or website. Continued use of the Service after changes constitutes acceptance.
